Terms of Service

These Terms of Service (“Terms”) govern your use of the POPPIN mobile application and the poppin.vip website (together, the “Service”), operated by POPPIN (“we”, “us”, “our”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. Certain features — including the guest list — require you to be at least 18. Nightlife venues shown in the app set their own age and entry requirements (commonly 18+ or 21+), which are entirely their own; appearing in Poppin does not entitle you to entry anywhere.

2. Your Account

You sign in with a one-time code sent to your email or phone number. You are responsible for the accuracy of the information on your account and for anything done through it. You may permanently delete your account at any time in the app (Settings → Delete Account).

3. What Poppin Is (and Isn’t)

Poppin is a nightlife discovery service: live crowd rankings, event listings, and links to venues and ticketing platforms. Poppin does not sell tickets, operate venues, or control events. Ticket purchases, table reservations, guest-list entry, and everything that happens at a venue are between you and the venue or its ticketing provider, under their terms. Event details, prices, and availability come from venues and ticketing platforms and can change or be wrong; always confirm with the venue.

4. Crowd Data and Votes

Vote features (“Poppin” / “Slow”, crowd ratio) reflect aggregated user submissions. They are opinions, not facts, and we make no guarantee about their accuracy. One vote per event; votes cast by automated means, from spoofed locations, or to manipulate rankings may be removed and the account suspended.

5. Acceptable Use

You agree not to:

(a) use the Service for any unlawful purpose; (b) impersonate any person or misrepresent your age, gender, or identity; (c) scrape, harvest, or bulk-download data from the Service; (d) interfere with or disrupt the Service or its servers; (e) attempt to access other users’ accounts or data; (f) use the Service to harass, stalk, or harm anyone, including venue staff and other patrons.

6. User Content

You retain ownership of content you submit (profile details, votes, requests). You grant us a worldwide, non-exclusive, royalty-free license to host, display, and use that content to operate and promote the Service (for example, showing aggregated crowd data). You are responsible for what you submit; we may remove content that violates these Terms.

7. Third-Party Services and Links

The Service links to third-party sites and services (ticketing platforms, venue sites, maps, social media). We are not responsible for their content, policies, or practices. Your use of them is at your own risk and governed by their terms.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT EVENT AND VENUE INFORMATION IS ACCURATE OR CURRENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POPPIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE — INCLUDING ANYTHING THAT OCCURS AT A VENUE OR IN CONNECTION WITH AN EVENT DISCOVERED THROUGH THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

10. Indemnification

You agree to indemnify and hold POPPIN harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms.

11. Suspension and Termination

We may suspend or terminate your access at any time for conduct that violates these Terms or harms the Service or other users. You may stop using the Service and delete your account at any time.

12. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute shall be brought in the state or federal courts located in Miami-Dade County, Florida.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will revise the “Last Updated” date above and provide notice in the app. Continued use after changes take effect constitutes acceptance.
